Elon Musk’s X Corp, the company formerly known as Twitter, is being sued by another social network also named X, a lawsuit filed in a federal court revealed. The lawsuit, filed by a Florida-based ad agency X Social Media LLC, alleged that the popular social media platform violates Florida common law because of “unfair competition and trademark and service mark infringement”. It also accused the company owned by Mr Musk of violating Florida’s Deceptive and Unfair Trade Practices Act (FDUPTA). The accusing company said it has existed in the American state with its registered trademark as “X SOCIALMEDIA” continuously since 2016. It said it has existed as “a vanguard in utilizing social media and marketing technology to connect consumers with legal services in situations where those harmed would otherwise remain voiceless and without remedy”. The Florida-based company, founded in 2015 by entrepreneur Jacob Malherbe, said its “distinctive” and “dominant” letter “X” is used to signify the beginning of a life-changing journey towards justice. The ad firm said its ”X” mark is successfully associated with its social media advertising services, adding that it has invested “over $2m to date” in building brand awareness and reaching consumers. It argued that it has “already suffered loss in revenue that correlates with X Corp’s rebrand and use of the mark ‘X’.” “In addition to the symbolic emphasis of the ‘X’, X Social Media frequently emphasizes the ‘X’ portion of its mark throughout its advertising, blogs, and newsletters highlighting its work,” the company said. “X Corp’s use of the ‘X’ mark and recent attempt to register the mark in association with social media, business data, promotion and advertising, business consulting, market research services, and advertising services necessitates this action because its conduct has caused and will continue to cause serious irreparable harm to X Social Media,” the ad agency says. It remains to be seen how X Corp would respond to the lawsuit. X Corp did not immediately respond to The Independent’s request for comment. TikTok prankster Mizzy has been banned from using social media after he was found guilty of posting videos without consent. The star, real name Bacari-Bronze O’Garro, was found to have “deliberately flouted” a court order prohibiting him from sharing videos of people without their consent “within hours” of it being passed. Judge Matthew Bone, overseeing the 19-year-old’s trial at Stratford Magistrates Court on Thursday, slammed O’Garro for “lacking all credibility” after he denied four counts of breaching the order. He ordered the father-of-one not to use social media “at all” except to send messages until he is sentenced next month and warned that he could go to prison for the offences he had committed. It comes after O’Garro’s defence lawyer Paul Lennon revealed to the court earlier on Thursday that his client had been arrested on suspicion of perverting the course of justice. O’Garro’s main witness in the case, who was due to give evidence at the trial, was also arrested and both were bailed on the condition that they do not contact each other. Mr Lennon attempted to adjourn the hearing, claiming O’Garro was unable to receive a “fair trial” without his only witness, but his application was rejected by Judge Bone. It was shown footage, shared on O’Garro’s Twitter account on the night of May 24 featuring him in Westfield shopping centre, Stratford, after he appeared on Piers Morgan’s TalkTV show and mocked the British judicial system. In the video, passersby were visible in the background as Mizzy said to the camera: “The UK law is a joke.” Other videos shared on O’Garro’s Snapchat account, which were also in breach, showed him grabbing hold of a schoolboy by his uniform and another showing him fight a man with dwarfism, which O’Garro claimed were hoax videos made with their prior agreement. O’Garro’s claim that one of his friends, who had access to his login details, posted the Twitter videos without his consent, was dismissed by Judge Bone as “inconceivable”. The judge said: “I have to say I did not accept the evidence of the defendant – it lacked all credibility. “Within hours of the criminal behaviour order he posed (in Westfield) stating the video would be shared and it was. “The defendant was filmed trying to shake a man’s hand from whom consent was not obtained. “He had just appeared on national television saying the British law was weak. “I found it to be an intentional, immediate and deliberate challenge to the criminal behaviour order. You need to understand that you deliberately flouted this court order within hours of it being made Judge Bone “Dealing again with charge four, two people were roughed up on camera by the defendant – I found his behaviour was again a deliberate challenge to the criminal behaviour order.” Judge Bone found O’Garro not guilty on two further counts of the same charge, ruling that the videos in question may already have been shared before the criminal behaviour order was passed. However, he warned O’Garro: “The defendant shouldn’t take much comfort from that. “What I have convicted him of crosses the custody threshold. “This is a man who has stepped over the line of the order in a deliberate way. “You need to understand the seriousness of your situation now. “You need to understand that you deliberately flouted this court order within hours of it being made.” O’Garro will be sentenced on November 21 at Thames Magistrates Court. Meta could soon launch a web version of Threads, as users grow frustrated with the lack of features on the platform. Threads was launched early in July, and quickly became the fastest growing app ever. It appeared to have been launched early to capitalise on the problems that have engulfed Twitter since Elon Musk bought it and renamed it X, and quickly gathered users as a result. That speed of launch does however appear to have left the app without a variety of basic features. In the weeks since, the company has been rushing to add new ways of using the app that have been missing since its launch. In recent days, for example, Threads has added the option to share threads posts on Instagram DMs, see a list of liked posts, and sort the accounts that are being followed. But it is still lacking perhaps the most basic feature of any social network: the ability to use it outside of an app. While many rival networks such as Twitter began as web versions, Threads still does not have a version that can be used on desktop computers or outside of the app. In a recent post, head of Instagram Adam Mosseri said the company is “working on it”. “We’ve been using an early version internally for a week or two,” he wrote on Threads. “Still needs some work before we can open it up to everyone though…” Mark Zuckerberg also said two weeks ago that the company was looking to build a “vibrant long term app” and that it had “lots of work ahead”. That includes the addition of “search and web”, which he said would arrive “in the next few weeks”. Now the Wall Street Journal has reported that the web version of the app could come as early as this week. But it noted that the “launch plans aren’t final and could change”. Threads does offer some features on the web. Users can click on links to Threads and see individual posts and replies, for instance, but there is no way to get back to a feed of accounts that a user is following. Instagram has always been relatively resistant to adding new platforms to its social network. The main Instagram app has only a relatively scaled-down version as its web offering, and it still does not offer a version of its app for iPad.
